Fake cases and Fraud

How do fake advocates impact the administration of justice? This is a phrase used so often that it feels so clichéd and jaded. Here is a glimpse of what it looks like to be subjected to them. Three fraudulently instituted criminal and civil trials. Three fake cases. Two continuing 13 year criminal trials instituted on fabricated orders of cognisance as part of a 15,000 crore scam. And one continuing 13 year civil trial instituted fraudulently with a fabricated ex-parte ad interim order of temporary injunction.

2010: the year my mother battled end stage colorectal cancer that left her disabled.

13 years. Three trials. Never filed.

This is what the impact of fake advocates on the administration of justice looks like.

Administration of Justice: 2010 “Scam” in the Court of the XIV Additional Chief Metropolitan Magistrate Court, Mayo Hall, Bengaluru

In the spring of 2022 my sister and I stumbled a series of investigative stories carried by Bangalore Mirror detailing a 15,000 crore “scam”. This occurred in the Court of the XIV Additional Chief Metropolitan Magistrate Court, Mayo Hall, Bengaluru. Stemming from a collusion between court staff, lawyers and banks. This included the running of a parallel court with fake judicial stamps, forging of the signature of the Presiding Officer, fake filing and registration of criminal cases and the illegal issuing of non-bailable warrants. All these cases were cheque bounce cases relating to S.138 of the Negotiable Instruments Act, 1881. The then Presiding Officer of the court, Dr.A.Gurumurthy discovered the “scam” and took action with threats to his life.

Bangalore Mirror reported the suspension of the Sheristadar, the bench clerk and a case worker who had colluded with banks and their advocates in running this ‘parallel court’. As also reported Dr.A.Gurumurthy had submitted a report to the High Court of Karnataka. He was subsequently immediately transferred out.

It is pertinent to state that the two criminal complaints filed against my mother were filed in this very court during the occurrence of the ‘scam’. These complaints bear prima facie evidence that these were indeed part of the ‘scam’.


P.C.R. No.1553 of 2010


Administration of Justice: Fake Order of Cognisance in P.C.R. No.1553 of 2010 = FAKE CRIMINAL TRIAL

On 19th January 2010, N.S.Vijaya Bhaskar Reddy [KAR/3540/2005] who works for G.A.Srikante Gowda allegedly filed a private criminal complaint on behalf of M.S.Krishnappa (now dead) against my mother. More so pertinently, M.S.Krishnappa filed this in the court of the XIV Additional Chief Metropolitan Magistrate, Mayo Hall, Bangalore.

The image above, on the left, is the cover page of the court order sheet of the complaint. In contrast on the right a Central Information System printed court order sheet. And so fraud is apparent on the face of the record.

M.S.Krishnappa subsequently filed Criminal Appeal No.1209 of 2019 in the High Court of Karnataka challenging the judgment acquitting my mother in this case.

P.C.R. No.5718 of 2010


Administration of Justice: Fake Order of Cognisance in P.C.R. No.5718 of 2010 = FAKE CRIMINAL TRIAL

On 18th March 2010, N.S.Vijaya Bhaskar Reddy [KAR/3540/2005] who works for G.A.Srikante Gowda allegedly filed a private criminal complaint (P.C.R) on behalf of Nagaraj against my mother. More so pertinently Nagaraj filed this in the court of the XIV Additional Chief Metropolitan Magistrate, Mayo Hall, Bangalore. M.Amaranatha, a fake advocate, prosecuted this criminal case from 2014 till 2020.

The fabricated order of cognisance is just the beginning of a 13 year horror story. Since what the fraud also includes is evidence tampering, forging of Judge’s signatures, false evidence, false depositions and false evidence to name a few.

We subsequently filed Writ Petition No.19222 of 2022 in the High Court of Karnataka assailing this. Currently subjudice. We are also challenging, in the Supreme Court of India, an interim order of the High Court of Karnataka that suo motu vacated a stay of proceedings of the appellate court.

O.S. No.964 of 2010

Administration of Justice: Fake Cover Page of Court Order Sheet in O.S. No.964 of 2010 =FAKE CIVIL TRIAL

On 25th October 2010, N.S.Vijaya Bhaskar Reddy [KAR/3540/2005] and M.Amaranatha [KAR/4790/1999] who work for G.A.Srikante Gowda allegedly filed an Original Suit on behalf of Nagaraj and 4 others against my mother.

The image above, on the left, is the cover page of the court order sheet. On the other hand, on the right a Central Information System printed court order sheet. And so to the naked “lay” eye, fraud is apparent on the face of the record. This fabricated court order sheet is just the tip of the iceberg. I believe additionally, with prima facie proof, that there has been forging of signatures of Presiding Officers, tampering with court records, fabrication of judicial orders, fabricated/forged/false evidence and depositions to name a few.

Furthermore I believe, on the basis of recent developments, that this case too is part of a larger manipulation of the filing system in the court of the Senior Civil Judge.

We subsequently filed Writ Petition No.9545 of 2023 in the High Court of Karnataka assailing this. Currently subjudice. We are also challenging the final order of dismissal and its’ revocation in a Special Leave Petition in the Supreme Court of India.
